Internal Complaints Committee (ICC)Introduction


In accordance with Section 4(1) of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, the School of Aeronautics, Neemrana has constituted an Internal Complaints Committee (ICC)to address complaints of sexual harassment and to ensure a safe, secure, and respectful environment for all female employees and students of the institution.

The Internal Complaints Committee is responsible for receiving, investigating, and redressing complaints related to sexual harassment while maintaining confidentiality and fairness throughout the process.

Who Can Approach the ICC?

The following individuals may approach the Internal Complaints Committee for assistance and redressal:

  • Female Faculty Members

  • Female Staff Members

  • Female Students

  • Female Contractual Employees

  • Female Visitors associated with the Institution

Any woman who feels subjected to sexual harassment within the campus or during any activity related to the institution may file a complaint with the ICC.

Definition of Sexual Harassment

As per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, “sexual harassment” includes any unwelcome act or behaviour, whether directly or by implication, such as:

  • Physical contact and advances.

  • Demand or request for sexual favours.

  • Sexually coloured remarks.

  • Showing pornography or offensive material.

  • Any unwelcome physical, verbal, or non-verbal conduct of a sexual nature.

  • Sending inappropriate emails, messages, social media communications, or digital content.

  • Any conduct that creates an intimidating, hostile, or offensive environment.

What Actions Can Be Taken Against the Respondent?

If the allegations are established through the inquiry process, one or more of the following actions may be recommended:

  • Warning

  • Written Apology

  • Bond of Good Behaviour

  • Adverse Entry in Service Records

  • Withholding of Promotion or Increment

  • Suspension from Duties or Academic Activities

  • Expulsion from Hostel Facilities

  • Dismissal or Termination from Service

  • Cancellation of Admission (in case of students)

  • Any other disciplinary action deemed appropriate by the competent authority

If You Are Harassed, What Should You Do?

A complainant may submit a written complaint to the Internal Complaints Committee along with supporting documents and details of witnesses, if any.

The complaint should contain:

  • Name and contact details of the complainant.

  • Description of the incident(s).

  • Date, time, and place of occurrence.

  • Supporting evidence, if available.

  • Names and addresses of witnesses, if any.

All complaints shall be treated with the utmost confidentiality.

Inquiry Process

The Internal Complaints Committee follows a fair, impartial, and confidential inquiry procedure as prescribed under the POSH Act, 2013.

Procedure

  1. Upon receipt of the complaint, the ICC shall initiate the inquiry process.

  2. The inquiry shall ordinarily be completed within 90 daysfrom the date of receipt of the complaint.

  3. Upon completion of the inquiry, the ICC shall submit its findings and recommendations to the competent authority within 10 days.

  4. Copies of the findings shall be made available to both parties.

  5. If the allegations are proved, the Committee shall recommend appropriate disciplinary action.

  6. The competent authority shall act upon the recommendations within 60 daysfrom the date of receipt of the report.

Confidentiality

The identity of the complainant, respondent, witnesses, and all records relating to the inquiry shall remain strictly confidential in accordance with the provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
